Terms of Service

These Terms of Service ("Terms") govern your access to and use of ClinicalStem (the "Service"), operated by Mangat Ram, based in Scotland, United Kingdom ("we", "us"). By creating an account or using the Service you agree to these Terms.
1. Educational purpose only
ClinicalStem is an independent educational platform and study aid for the Australian Pharmacy Council's (APC) registration assessments. It is not affiliated with, endorsed by, sponsored by, or connected to the Australian Pharmacy Council, AHPRA, or any government or regulatory body. Practice questions and explanations are provided for educational purposes and do not constitute clinical, medical, or professional advice. We do not guarantee any particular exam outcome. Australian pharmacy practice and guidelines change over time — you remain responsible for verifying information against official guidelines, legislation, and professional resources before relying on it in practice.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and be at least 18 years old (or have the consent of a parent or guardian). Each subscription is intended for use by one individual user unless a separate multi-user licence has been agreed with us.
3. Subscriptions and billing
Paid plans are billed in advance, in Australian dollars (AUD) unless otherwise stated, through our payment processor (Stripe) on a recurring or fixed-term basis until cancelled or expired. Access to paid content begins immediately once payment is confirmed. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period and you retain access until then. Fees are otherwise non-refundable except where a refund is required by law. If a payment fails, we may retry it or suspend access to paid features until payment succeeds. We may change pricing for future billing periods, with reasonable notice before the change takes effect on your account.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.
4. Acceptable use
You agree not to:
- share, resell, or redistribute account access or question content;
- scrape, copy, or bulk-export the question bank or learning materials, including by using automated tools, scripts, bots, or artificial intelligence systems to extract, reproduce, or recreate the content;
- reverse-engineer or interfere with the Service's operation; or
- use the Service unlawfully or to infringe others' rights.
5. Intellectual property
All content on the Service — including questions, explanations, and course materials — is owned by us or our licensors and is protected by copyright. We grant you a limited, personal, non-transferable licence to use it for your own exam preparation only.
6. AI-generated content
Some content on the Service was developed with the assistance of artificial intelligence tools, reviewed for accuracy before publication. AI-assisted content may nonetheless contain errors and should not be relied upon as a substitute for official educational materials, current clinical guidelines, or your own professional judgement.
7. Availability of the Service
We may modify, suspend, or discontinue features of the Service from time to time, including question content, tools, or the number of questions available. We will try to give reasonable notice of material changes that reduce what a paid subscription includes.
8. Disclaimers and limitation of liability
The Service is provided "as is". To the maximum extent permitted by law, and subject to any non-excludable consumer guarantees, we exclude all warranties and our total liability arising out of or in connection with the Service is limited to the amount you paid us in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your access if you breach these Terms. You may stop using the Service and delete your account at any time.
10. Governing law
These Terms are governed by the laws of Scotland, and you submit to the non-exclusive jurisdiction of the Scottish courts. This does not remove any non-excludable consumer protections you are entitled to under the law of the country where you live, including the Australian Consumer Law referred to in Section 3.
11. Changes
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.
